Tolls from 2023: examine possible refunds.

Point Zero Legal supports companies and corporate groups with fleets that have paid at least €500,000 in German truck tolls in total since 2023. The toll years 2023–2026 are examined. Your actual statements are decisive, not a flat repayment rate.

Relevant for

Freight forwarders, transport, logistics, construction, waste disposal, trade and contract traffic. Foreign companies that paid tolls in Germany may also contact us; multiple entities within a group are considered together.

Records

Original monthly statements from January 2023 and the Excel template from the data room – assigned by company, toll account and vehicle.

Review question

Point Zero Legal records the data and checks it for completeness. Octagon Capital checks the financing. The mandated law firm Martin Pfnür examines possible claims and the further legal steps.

The review is not directed against Toll Collect or your toll service provider, but concerns possible refunds by the Federal Republic of Germany. Your ongoing toll processing remains unaffected. Vignettes and tolls of other countries are not covered.

Calculation basis

Road-cost study 2023–2027

The toll from 2023 is based on the Wegekostengutachten 2023–2027. Martin Pfnür has identified twelve points of approach in the calculation, including capital costs, land costs, cost allocation and the CO₂ component. Which points apply in the specific case is examined by the law firm.

Review point 01

Imputed capital costs

One aspect under review concerns the capital and land costs used in the study. Specialist lawyers examine whether individual calculation assumptions comply with EU rules on chargeable infrastructure costs.

Review point 02

CO₂ component since December 2023

Since 1 December 2023, the German truck toll has included an external-cost component differentiated by CO₂ emission class. The German implementation is being assessed against the Eurovignette Directive, without anticipating the legal outcome.

Why it may be worth reviewing your toll payments.

2023 is particularly relevant: before the CO₂ surcharge on 1 December 2023 about 80% of the toll related to infrastructure, since 2024 about 44%. These are averages; your actual share depends, among other things, on vehicle and emission class. Tolls for 2027 are not yet included.

No confirmed refund rate yet for tolls from 2023.

According to the provided information there is no decision for the toll years from 2023 that confirms a refund claim or a specific rate. Whether and in what amount refunds will follow must be legally clarified. The result may be higher or lower or may not occur at all.

Assessment by Martin Pfnür and Octagon Capitalapprox. 10–25%

The assessment refers to the infrastructure share of the toll, not to the total toll paid. It originates from the expert interview on 8 October 2026 and is neither a promised repayment nor a court‑confirmed rate. Interest may be added where applicable.

2023 first: prepare documents by mid‑November.31.12.2026

Possible claims relating to 2023 may generally become time-barred on 31 December 2026. Please provide complete documents by mid-November 2026 to allow time for preparation. This is an operational preparation deadline, not a statutory limitation deadline. The law firm assesses the applicable limitation period and steps required to preserve claims in each case.

Clear roles · simple process

From your toll statements to the expert review.

First tell us your approximate toll volume since 2023 and the affected entities. We then assist with compiling the statements and the Excel template. All terms are provided in writing before engagement.

  • Point Zero Legal: initial intake, compilation and completeness check of the documents.
  • Octagon Capital: financing review and, after confirmation, assumption of contractually covered procedural costs and the litigation cost risk.
  • Law firm Martin Pfnür: legal review, calculation and pursuit of possible claims.
  • After engagement and financing confirmation, the law firm takes over the further legal steps. Point Zero Legal does not provide legal advice.
No advance payment after financing commitment.

Octagon Capital bears the contractually covered procedural costs and the risk of litigation costs after written commitment. Only if a refund is actually received are a 35% success fee and a verification fee per toll month charged. If no refund occurs, neither is charged. Financing and terms are reviewed in advance and agreed in writing.

A simple calculation example – no refund promise.

Assume a company pays €600,000 in tolls each year from 2023 to 2026. That is €2,400,000 in total. With simplified infrastructure shares of 80% for 2023 and 44% from 2024 this yields a calculation base of €1,272,000.

€127,200Theoretical potential at 10% of the infrastructure share
€82,680After 35% success fee, before verification fee and taxes

€127,200 × 65% = €82,680. The verification fee per toll month must be deducted in addition; interest and taxes are not included. Even annual payments and average shares are assumptions. The actual outcome may differ or may not occur at all.

Original toll invoices/statements are decisive.

Secure your original statements directly in the portal of the toll service provider. Older documents are not available there indefinitely. The documents are sorted by company, toll account and vehicle.

  • Original monthly statements from January 2023 from Toll Collect, Toll4Europe, Telepass or your provider, as PDF or data export
  • Completed Excel template with company and fleet data from the data room
  • Commercial register excerpt and proof of identity of the authorized signatory for further processing
  • Available payment records, annual summaries and information on already commissioned providers; pure fuel or card statements may be insufficient

Your questions about tolls, the truck cartel and tires.

General questions

4
Do I need to know which topic is relevant?

No. An unclear starting position is normal. During the initial call, we consider tolls, truck proceedings and tyre purchases separately.

Which records should I have ready?

Monthly statements since 2023 are useful for tolls. Vehicle and procedural records matter for the truck cartel. For tyres, invoices or an accounting export are sufficient initially.

What if claims have already been filed?

We then need the provider, contractual model and current status. Whether any further step is required can only be assessed after reviewing the individual case.

Will I receive legal advice on this website?

No. This website provides general orientation. Legal assessments are made exclusively by appropriately admitted lawyers.

Statements since 2023, infrastructure share, costs and deadlines.

Who is the review of the German truck toll from 2023 intended for?

It is aimed at companies and corporate groups with fleets that have paid at least €500,000 German toll in total since 2023. This includes, among others, forwarding agents, transport and logistics companies, construction logistics, waste disposal, trade and works traffic. Whether a review makes sense depends on your actual statements and the subsequent legal review.

Can foreign companies also register?

Yes, foreign companies with toll payments in Germany can register for structured initial intake. Multiple companies within a group can be considered together. Only the German truck toll is covered; tolls or vignettes from other countries are not included.

Why is the toll year 2023 particularly important?

Until the introduction of the CO2 surcharge on 1 December 2023 on average around 80 percent of the toll related to the infrastructure share; from 2024 it is on average around 44 percent. These values are not an individual calculation and depend, among other things, on vehicle and emission class. For possible claims from 2023 limitation of actions generally threatens on 31 December 2026. Complete documents should be available by mid-November 2026; this is an operational preparation period, not a statutory deadline. The concrete deadline and required steps are examined by the law firm.

What does the assessment of 10 to 25 percent mean?

The assessment of about 10 to 25 percent refers to the infrastructure share of the paid toll, not to the entire toll. It originates from the assessment of Martin Pfnür and Octagon Capital and is not a legally confirmed reimbursement quota. The result can be higher or lower or may not occur at all.

Which points of the toll calculation are examined from 2023?

The legal review can address points in the road cost study 2023–2027 and in the CO2 partial toll rate charged since 1 December 2023. These include, for example, imputed capital costs, land costs, cost allocation as well as amount, possible double charging and classification of the CO2 component. Which points apply in the concrete case can only be assessed on the basis of the statements and by the law firm.

What do earlier toll judgments say about the toll from 2023?

Earlier decisions concern other toll years and legal questions: the CJEU case C-321/19 and subsequent decisions dealt, among other things, with traffic police costs and capital costs for earlier periods. The Administrative Court Cologne awarded police costs for 2016 to 2020 in 2024; according to the available information this decision is not yet final. This does not constitute a guarantee and no specific reimbursement quota for the toll from 2023.

What costs arise and is financing automatically confirmed?

No. Octagon Capital examines the financing and agrees the conditions in writing. Only after confirmation are the contractually covered procedural costs and the litigation cost risk assumed. Only in the event of an actual reimbursement do 35 % success fee and a review fee per toll month apply; without reimbursement neither applies.

Which documents are required for the toll review?

Important are the original monthly statements from January 2023, preferably as PDF or data export from the portal of the respective toll service provider. In addition, a completed Excel template and allocation by company, toll account and vehicle help; proof of payment and annual overviews can complement. Pure fuel or credit card overviews may not be sufficient.

Do I have to continue paying the German toll?

Yes, ongoing toll processing remains unaffected by the review and must continue according to the applicable rules. The review concerns possible reimbursements for tolls already paid in Germany and does not replace ongoing payment or processing obligations. No statement about a later result is associated with this.

Is the review directed against Toll Collect?

No. The possible reimbursement according to the presented review idea concerns the Federal Republic of Germany and not Toll Collect or any other toll service provider as defendant. The service provider can nevertheless be important because original statements and data exports are provided there.

What happens if claims have already been pre-registered or other providers have been instructed?

Please inform us when and with whom claims were pre-registered, which contract exists and what the current status is. This information is taken into account in the initial intake; a pre-registration neither confirms existence nor enforceability of a claim. Whether further steps are sensible is examined by the mandated law firm based on the concrete case.
