Statements since 2023, infrastructure share, costs and deadlines.
Who is the review of the German truck toll from 2023 intended for?+
It is aimed at companies and corporate groups with fleets that have paid at least €500,000 German toll in total since 2023. This includes, among others, forwarding agents, transport and logistics companies, construction logistics, waste disposal, trade and works traffic. Whether a review makes sense depends on your actual statements and the subsequent legal review.
Can foreign companies also register?+
Yes, foreign companies with toll payments in Germany can register for structured initial intake. Multiple companies within a group can be considered together. Only the German truck toll is covered; tolls or vignettes from other countries are not included.
Why is the toll year 2023 particularly important?+
Until the introduction of the CO2 surcharge on 1 December 2023 on average around 80 percent of the toll related to the infrastructure share; from 2024 it is on average around 44 percent. These values are not an individual calculation and depend, among other things, on vehicle and emission class. For possible claims from 2023 limitation of actions generally threatens on 31 December 2026. Complete documents should be available by mid-November 2026; this is an operational preparation period, not a statutory deadline. The concrete deadline and required steps are examined by the law firm.
What does the assessment of 10 to 25 percent mean?+
The assessment of about 10 to 25 percent refers to the infrastructure share of the paid toll, not to the entire toll. It originates from the assessment of Martin Pfnür and Octagon Capital and is not a legally confirmed reimbursement quota. The result can be higher or lower or may not occur at all.
Which points of the toll calculation are examined from 2023?+
The legal review can address points in the road cost study 2023–2027 and in the CO2 partial toll rate charged since 1 December 2023. These include, for example, imputed capital costs, land costs, cost allocation as well as amount, possible double charging and classification of the CO2 component. Which points apply in the concrete case can only be assessed on the basis of the statements and by the law firm.
What do earlier toll judgments say about the toll from 2023?+
Earlier decisions concern other toll years and legal questions: the CJEU case C-321/19 and subsequent decisions dealt, among other things, with traffic police costs and capital costs for earlier periods. The Administrative Court Cologne awarded police costs for 2016 to 2020 in 2024; according to the available information this decision is not yet final. This does not constitute a guarantee and no specific reimbursement quota for the toll from 2023.
What costs arise and is financing automatically confirmed?+
No. Octagon Capital examines the financing and agrees the conditions in writing. Only after confirmation are the contractually covered procedural costs and the litigation cost risk assumed. Only in the event of an actual reimbursement do 35 % success fee and a review fee per toll month apply; without reimbursement neither applies.
Which documents are required for the toll review?+
Important are the original monthly statements from January 2023, preferably as PDF or data export from the portal of the respective toll service provider. In addition, a completed Excel template and allocation by company, toll account and vehicle help; proof of payment and annual overviews can complement. Pure fuel or credit card overviews may not be sufficient.
Do I have to continue paying the German toll?+
Yes, ongoing toll processing remains unaffected by the review and must continue according to the applicable rules. The review concerns possible reimbursements for tolls already paid in Germany and does not replace ongoing payment or processing obligations. No statement about a later result is associated with this.
Is the review directed against Toll Collect?+
No. The possible reimbursement according to the presented review idea concerns the Federal Republic of Germany and not Toll Collect or any other toll service provider as defendant. The service provider can nevertheless be important because original statements and data exports are provided there.
What happens if claims have already been pre-registered or other providers have been instructed?+
Please inform us when and with whom claims were pre-registered, which contract exists and what the current status is. This information is taken into account in the initial intake; a pre-registration neither confirms existence nor enforceability of a claim. Whether further steps are sensible is examined by the mandated law firm based on the concrete case.
