Second focus · Truck cartel

Truck procurements 2003–2014: secure documents, review options.

The presented model considers purchases, leasing and financing transactions from 01.01.2003 to 31.12.2014. The cartel officially found by authorities ran from January 1997 to January 2011; 2012–2014 are examined separately as possible follow-on years. Inclusion does not yet confirm a claim.

Federal Court of Justice ruling KZR 6/24

Germany’s Federal Court of Justice clarified the limits of bundled debt-collection actions in the truck-cartel litigation. Bundled enforcement was not rejected as such. Courts may, however, require preparation for separating proceedings where jointly handling highly diverse claims would make effective judicial protection practically difficult.

  • The procedural model and litigation-funding agreement may be relevant to the legal assessment.
  • Companies in pending collective proceedings should be able to identify how their individual case is structured.
  • The ruling primarily concerns procedural structure; the appointed law firm assesses its impact on each company.

What the truck factsheet explains for your fleet.

Vehicles, manufacturers and documents

Considered are medium and heavy trucks from 6 tonnes by MAN, Mercedes-Benz/Daimler, DAF, Iveco, Volvo/Renault Trucks and Scania. Leased or financed vehicles and trucks sold in the meantime can also be relevant. Claims are directed against cartel participants, not against dealers, workshops or lessors.

Individual lawsuit or small association of claimants

The factsheet describes an individual lawsuit from 100 trucks and below that a small association of claimants. In both cases each company remains a party, with a calculation per vehicle. The law firm checks the appropriate procedural route; the number of vehicles is not an automatic guarantee for inclusion or financing.

Orientation from past cases – no fixed quota

The factsheet names historical orientation values of 5 % for 2003–2011 and for the follow-on years 3 % (2012), 2 % (2013) and 1 % (2014), each based on a simplified net purchase price. A historical average of about 10 % including interest is also no guarantee. Actual purchase prices, contracts and legal prerequisites are decisive.

Orientation from past cases – no fixed quota
Procurement yearHistorical orientation value
2003–20115 %
20123 %
20132 %
20141 %

The examples use a simplified assumption of 5 % simple interest per year until the end of 2026. Whether interest is owed and from when is determined by the law firm; neither the rate nor the period automatically apply to every case. Past results are not an indicator of future results.

Deduct 35 % success fee transparently

For the following examples, according to the presented financing model a success fee of 35 % of the total amount including interest is deducted. 65 % remain calculated before taxes and any further contractually agreed deductions in writing. The binding calculation basis and costs are governed by the financing agreement. The toll review fee per month is not transferred to truck cases here.

Secure old documents now

Keep vehicle lists, purchase and leasing contracts, invoices, VINs, prices and procurement data. Data may still be in the asset register, with accounting, tax advisor or lessor. Do not destroy possibly relevant documents before review.

Existing registered claims? No hasty decision.

Provide existing contracts, assignments, vehicle lists and the last procedural status. Whether a change, termination or further steps are possible and sensible is examined by the law firm. The BGH judgment of 12.05.2026 does not categorically dismiss bundled assertions.

Truck calculation examples with deduction of the 35 % success fee

The examples adopt the simplified assumptions from the factsheet: €80,000 net purchase price per truck, vintage-dependent rates and 5 % simple annual interest until the end of 2026. They are calculation examples, not a forecast or guarantee of a claim.

One truck · purchase 2004

€80,000 × 5 % = €4,000 damages. Simplified 22 years × 5 % on €4,000 equals €4,400 interest. Total: €8,400; minus €2,940 success fee leaves €5,460 calculated.

Example with 50 trucks

The procurements distributed in the factsheet yield €176,000 damages and €161,200 interest. Of a total €337,200, €118,020 success fee is deducted; €219,180 remain calculated.

Example with 150 trucks

The procurements distributed in the factsheet yield €528,000 damages and €482,000 interest. Of a total €1,010,000, €353,500 success fee is deducted; €656,500 remain calculated.

All amounts are non-binding examples. Start and amount of interest, actual purchase prices and other contract terms are examined individually. Taxes and further possibly agreed deductions are not included. The actual result may differ or not materialize at all.

Frequently asked questions

Your questions about tolls, the truck cartel and tires.

General questions

4
Do I need to know which topic is relevant?

No. An unclear starting position is normal. During the initial call, we consider tolls, truck proceedings and tyre purchases separately.

Which records should I have ready?

Monthly statements since 2023 are useful for tolls. Vehicle and procedural records matter for the truck cartel. For tyres, invoices or an accounting export are sufficient initially.

What if claims have already been filed?

We then need the provider, contractual model and current status. Whether any further step is required can only be assessed after reviewing the individual case.

Will I receive legal advice on this website?

No. This website provides general orientation. Legal assessments are made exclusively by appropriately admitted lawyers.

Procurements 2003–2014, procedural routes and examples after success fee deduction.

Which truck procurements can generally be relevant?

Relevant are medium and heavy trucks from 6 t that were bought, leased or financed between 01.01.2003 and 31.12.2014. The factsheet names the involved manufacturers as MAN, Mercedes-Benz (Daimler), DAF, Iveco, Volvo/Renault Trucks and Scania. Whether a claim exists depends on the specific vehicles, documents and legal review.

Do I have to still own the trucks today?

No. Current ownership is not required; what matters is that the procurement falls within the relevant period. Trucks already sold, returned or paid off can also be reviewed if the procurement can be sufficiently documented.

Which procurement years are currently considered?

The initial intake covers procurements from 01.01.2003 to 31.12.2014. The years 2012–2014 are examined separately as possible follow-on years. Inclusion does not yet confirm a claim or financing.

Which deadlines apply to the procurement years?

According to the current assessment, in particular the 2003 vintage is likely actionable until 31.12.2026; other vintages may become time-barred at year-end. This is not a blanket guarantee: the law firm checks deadlines, manufacturer, applicable law and measures already taken on a case-by-case basis.

What can interrupt limitation periods?

Already filed lawsuits, administrative proceedings or other measures that interrupt limitation periods can change the calculation. Whether a specific measure is sufficient and what consequences it has can only be determined based on your case and the available evidence.

Which documents should I collect for the review?

Helpful are vehicle lists, invoices, purchase, leasing or financing contracts, price and contract data as well as information on claims already registered. Documents may also be with the tax advisor, in accounting, the asset register or with the lessor.

How is the possible damage calculated?

Calculation is made individually per vehicle, purchase year, net purchase price and contract type. As historical orientation the factsheet names 5 % for 2003–2011, 3 % for 2012, 2 % for 2013 and 1 % for 2014; this does not constitute a guaranteed quota.

How are interest rates treated in the examples?

The examples use a simplified 5 % interest per year from the purchase year until the end of 2026. This is a simplified assumption; start, amount and actual interest accrual are reviewed by the law firm based on the concrete circumstances.

What remains of €8,400 from the example purchase of 2004 after the success fee?

With a sample net purchase price of €80,000 this yields €4,000 damages plus €4,400 simplified interest totaling €8,400 before success fee. At 35 % success fee on this total, €5,460 remain calculated; the example is no guarantee of a claim or result.

How should the examples for 50 and 150 trucks after 35 % success fee be understood?

The factsheet states approximately €337,200 for 50 trucks and approximately €1,010,000 for 150 trucks, each before success fee and based on simplified assumptions. After 35 % on the respective total amounts, approximately €219,180 or €656,500 remain calculated; actual amounts may differ or not materialize.

Which costs and participation apply?

For the presented examples a success fee of 35 % on the total amount including interest is deducted. Calculation basis, cost coverage and possible further deductions are agreed in writing in the financing agreement in advance. The toll review fee per month is not transferred to truck cases without agreement; the concrete contract applies.

How is the procedure classified according to the number of trucks?

From 100 trucks an individual lawsuit is generally envisaged. Below 100 trucks a small association of claimants may be considered, with each company remaining a party; there is no guarantee for inclusion or success.

What does the BGH judgment mean for cases already registered?

The BGH did not categorically dismiss bundled assertions in the truck cartel, but pointed out limits for collective claim collection and the preparation of case separation. Already pre-registered or ongoing cases should therefore be reviewed individually based on contract, procedural status and documents; do not terminate without legal review.

Who does what and against whom is a potential claim directed?

Point Zero Legal works with Octagon Capital on initial intake and document preparation; Octagon Capital works with the law firm Martin Pfnür. There is no contractual cooperation between Point Zero Legal and the law firm Martin Pfnür, and Point Zero Legal does not provide legal advice. Possible claims are directed against cartel participants, not against dealers, workshops or lessors.
